What are Trademark and Patent?
Trademarks are signs that represent all the assets of an enterprise, are used to distinguish similar goods and services from the goods or services of other enterprises, and enable the products to be distinguished. Brands are like fingerprints that play an important role throughout the commercial life of businesses and reflect the identity of these businesses. Brands, which show the source of the product to the consumer, are also a symbol of quality and an important promotional tool.
When creating a brand, words, letters, numbers, shapes, sounds and colors, including first and last names, a combination of some or all of these, and even the shape or packaging of products are acceptable. A brand is not just a name, it is also known as your identity and image. Products and services create a market with their own names. It must be able to communicate and cooperate between the brand and the consumer. Therefore, the trademark is a signature and advertisement of your business.
How to Get a Patent?
Patent, in simple terms, is to secure the rights of the person who creates an invention or a new product on this invention or product. In other words, the person who makes the invention or produces the product becomes the right holder in areas such as the sale, reproduction and marketing of the invention or product, and no one other than the product owner can make a similar product or sell this product. In short, with a patent, all rights on a product are legally granted and secured to the product owner.
What is the Difference Between Trademark Registration and Patent Registration?
Patent is a concept that is often confused with trademark registration. A patent protects an invention or new product, while a trademark registration protects a service or good. Although trademark registration and patent registration are different from each other, the only institution authorized to register both is the Turkish Trademark and Patent Office.
Trademarks registered by the Turkish Patent and Trademark Office can be passed down from generation to generation and become a family (company) heritage by being extended every 10 years from the date of application upon the request of the owner. Patent registration provides protection for a certain period of time, 7-19 or 20 years, due to the novelty of the invention, and at the end of these periods, inventions are considered to be public property.
